Service Agreement

Please be sure to read and understand all the rights and restrictions set forth in the User Service Agreement (hereinafter referred to as this Agreement). You are not authorized to register, log in, or use the services covered by this Agreement unless you accept the terms of this Agreement. By registering, logging in, using, or in any way using the services covered by this Agreement, you will be deemed to have accepted this Agreement, and you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, please do not register, log in, or use the services outlined in this Agreement.

1. Service content

1.1 The owner and operator of App, will provide internet-based and mobile internet-related services (hereinafter referred to as “network services”) in accordance with its published terms of service and operating rules. The specific services are subject to the actual circumstances of App. The specific content of the App network service is provided by App according to the actual situation, including but not limited to personal services and App products such as APP, App intelligent hardware. App reserves the right to adjust, improve or suspend the provision of certain services regarding the App services at any time for the purpose of providing better service to users.
1.2 Once you have successfully registered as a user, you will receive a password and account number, and you will be fully responsible for all actions taken by your account. If your account and password are compromised due to your negligence, you will be solely responsible for any damage caused to you, App, or any third party.
1.3 Users should enter their account and password to log in to the App account. In order to provide you with a more convenient login service,APP provides a third-party login service, which you can use to log in with a third-party license.
1.4 Users understand and accept that App only provides related network services. In addition to related network services related equipment (such as personal computers, mobile phones, and other devices connected to the Internet or mobile Internet) the cost (such as the telephone and internet fees paid for access to the internet and the mobile phone fees paid for the use of the mobile network) are be borne by the user.

2. Rules on the use by users

2.1 When applying for the App network service, users must provide App with accurate personal information. If there is any change in personal information, it must be updated in time. The user shall bear all consequences arising from the inaccurate and untrue personal information provided by the user.
2.2 Users shall not transfer, lend, sell, or otherwise in any form that is out of user control, deliver their account number, and password for use. If the user discovers that their account has been illegally used by others, they should immediately notify App. App does not assume any responsibility for the illegal use of accounts and passwords due to hacking or negligence of users.
2.3 The ownership of the App account is owned by App. After completing the registration application, the user will be granted access to the App account.
2.4 The user shall be responsible for all actions under own registered account, and App shall not be liable for any loss or damage caused by the user’s own actions or any other third party.
2.5 Users understand and accept that the services provided by App may include advertisements, and users agree to display advertisements provided by App, third-party suppliers, App partners during use of its network services.
2.6 In order to facilitate users to use App related services, users understand and accept that App can, through email, SMS, telephone, direct message, pop-up message, client push, etc., send to App network service registered users, shopping users and consignees the notifications and information such as public notices, order information, promotions, advertisements, etc.
2.7 In order to facilitate the use of App and App partners’ services, the user agrees and authorizes App to share with App’s partners the user information necessary to implement the web services.
2.8 The user must follow the following principles when using App network services:
2.8.1 Comply with relevant national laws and regulations.
2.8.2 Comply with all network protocols, regulations, and procedures related to network services.
2.8.3 The network service system shall not be used for any illegal purpose.
2.8.4 Do not use App’s network services to conduct any behavior that may adversely affect the normal operation of the internet or the mobile network;
2.8.5 Do not use the online services provided by App to upload, display or transmit any false, harassing, libelous, abusive, intimidating, vulgar, obscene, or any other sensitive information.
2.8.6 Do not engage in infringements of patent rights, copyrights, trademarks, reputation rights or any other legal rights of App and related third parties;
2.8.7 Do not use the App network service system to conduct any actions against App;
2.8.8 App should be notified immediately in the event of any illegal use of user’s account or of account with security hole.
2.9 During the use of App network services, users must abide by the relevant provisions of the laws of China such as the Cybersecurity Law of the People’s Republic of China, Law of the People’s Republic of China on the Protection of Heroes and Martyrs, and the Anti-Secession Law of the People’s Republic of China, and not engage in any of the following actions, including but not limited to:
1) Against the basic principles determined by the constitution;
2) Impair national security, divulge state secrets, subvert state sovereignty or jeopardize national unity;
3) Damage the reputation and interests of the state;
4) Incite ethnic hostility and ethnic discrimination or jeopardizes unity among ethnic groups;
5) Damage national religious policies or that advocates sects or feudal superstitions;
6) Disseminate rumors, disrupt the social order or damage social stability;
7) Disseminate obscenity, pornography, gambling, violence, homicide and terror, or that incites crime;
8) Insult or slander others’ lawful rights and interests, including but not limited to infringing upon the name, portrait, reputation, honor, or defamation of heroic martyrs, or denying the deeds and spirit of heroic martyrs by insult, defamation or other means;
9) Otherwise prohibited by laws or administrative regulations.
2.10 If a user violates any of the above provisions when using the network services, App or its authorized person has the right to request the user to correct or directly take all necessary measures (including but not limited to changing or deleting the content posted and collected by the user, suspending or terminating the user’s right to use related network services) to mitigate the impact of user misconduct.

3. Service change, interruption or termination

3.1 Due to the specificity of the network service, the user agrees that App has the right to change, discontinue, or terminate some or all of the network services at any time without notice to the user (unless the law clearly stipulates), and does not assume any responsibility to any user or any third parties.
3.2 Users understand that App need to repair or maintain the platform that provides network services (such as Internet websites, mobile networks, etc.) or related equipment on a regular or irregular basis. App does not bear any responsibility for the interruption of network services within a reasonable time due to such circumstances, but App will do its best to give as much advance notice as possible.
3.3 App reserves the right to discontinue or terminate the provision of the network services (including the charged network services) under this Agreement at any time without any liability to the user or any third party, in the event of any of the following:
3.3.1 The personal data provided by the user is inaccurate or false.
3.3.2 The user violates the usage rules stipulated in this Agreement.

4. Intellectual property

4.1 Any text, images, graphics, audio and/or video material contained in the network services provided by App are protected by copyright, trademark and/or other property rights laws. The abovementioned materials must not be used for any commercial purposes without the consent of the relevant rights holders.
4.2 All rights to any software used by App for the provision of web services (including but not limited to any images, photos, animations, videos, recordings, music, text and additional programs contained in the software, accompanying help materials) belong to the copyright owner of the software, and the user shall not reverse engineer, decompile, or disassemble the software without the permission of the copyright owner of the software.
4.3 If the user violates this Agreement and infringes the relevant intellectual property rights of the right holder or the third party, the user shall bear the corresponding responsibility and, if App therefore suffers the corresponding loss or assumes the relevant responsibility, App has the right to request the user to compensate for the loss.

5. User privacy policy

Please refer to the App User Privacy Policy for details.

6. Cancellation of account

1) If the user account has the following circumstances, App reserves the right to suspend the provision of services, ban accounts, and until the account is cancelled:
6.1.1 The registration information submitted by the user is not true and complete, and has not been modified or corrected upon receipt of App’s notice;
6.1.2 The account has not been used more than [365] days after user registered the account;
6.1.3 The user does not have the age and other conditions required to register the account;
6.1.4 The user involves the illegal situations or has to cancel the account according to the requirements of the state agency.
6.2 If the user files an application for account cancellation with App, the account can be cancelled with the consent of App when the account meets the following conditions:
6.2.1 The account had been for [7] days and successfully activated;
6.2.2 The account has no disputes (such as no transaction disputes, no account ownership disputes, etc.);
6.2.3 There are no other accounts that should not be logged out.
6.3 If the user files an application for account cancellation with App, App reserves the right to reject the application upon verification of the following circumstances:
6.3.1 The account has a balance (including funds, card vouchers obtained through recharge or participation in activities, gifts and other virtual property);
6.3.2 The account has unfinished transactions;
6.3.3 The account has ongoing business (such as applying for a password, modifying the mobile phone number, cloud service subscription, etc.);
6.3.4 There are other circumstances in the account that do not permit account cancellation.
6.4 If the user cancels the account, the application shall be filed in accordance with the procedures required by App, and the account can be cancelled after being confirmed by App. The account cancellation will take effect from the date App notifies the user through the mailbox and SMS reserved by the user.
6.5 The user has fully understood and confirmed that the user will no longer have account-related benefits after the account is cancelled, including but not limited to:
6.5.1 After the account is cancelled, the user will not be able to continue to use the account in any App product, and the cancelled account cannot be recovered;
6.5.2 The mailbox or mobile phone number to which the account is bound will not be used for registering or binding to other App accounts within 10 days;
6.5.3 Account information, subscription information in the account, information stored by the user, etc. will be cleared and cannot be recovered;
6.5.4 The transaction record of the account will be cleared and cannot be recovered;
6.5.5 Possible refunds or interests you win in historical orders will be considered as automatic waiver;
6.5.6 After the account is cancelled, App reserves the right to no longer provide any account-related services to the user.
6.6 Inconvenience or adverse consequences caused by account cancellation shall be borne by the user and not be related to App.

7. Instructions for trial use and paid subscription service

7.1 Trial use: one and only one chance is available for each account to apply for trial use of cloud service. The trial service lasts for 14 days and includes 7 days of video cloud storage. Only one legal App device under this account is supported. This service cannot be transferred, unsubscribed, and the bonded device cannot be replaced. This service will be closed once the 14-day trial is over. Unless you pay the subscribtion full or monthly.
7.2 Paid subscription service: when you pay for a subscription, you need to choose the device to subscribe the service as well as a service package.You can paid subscription full or sign up a continuous contract to paid monthly.
7.2.1 Paid full: The package contract takes effect immediately upon completion of the payment. The subscription service cannot be unsubscribed, transferred, and the bonded device cannot be replaced. If a new subscription service is purchased on the basis of an unexpired subscription service, the subscription service will take effect immediately after the current subscription service expires, and it is permitted to contact App to cancel the subscription for refund before the new subscription service becomes effective.
​7.2.2 Paid monthly: The package contract takes effect immediately upon completion of the payment. This subscription plan entitle you to access Cloud Storage service for each payment period until such subscription is cancelled. Your paid subscription will automatically commence on the first day following the end of your previous period, and will automatically renew on a monthly. By submitting your payment details in conjunction with the subscription, you agree to this charge. To avoid this charge, you must cancel your Cloud Storage service by either contacting us before the end of your current period or discontinuing the Cloud Storage service via the APP. The subscription service cannot be transferred, and the bonded device cannot be replaced.
7.3 Please refer to Service Change, Interruption or Termination for subscription service termination.

8. Cancellation and Refunds Policy

8.1 Cancellation of Subscription Services: You may cancel your Cloud Storage Service by contacting us or through your account, at any time, with or without cause. After your cancellation, you will continue to enjoy access to the Cloud Storage Service and your Cloud Recordings until the last day of your subscription period. After such subscription period ends, your Cloud Recordings will no longer be accessible to you.
8.2 Refunds Policy: You will be refunded a prorated amount, based on how much time you have left in your Cloud Storage Service.
8.2.1 Annual Plans: If you cancel your annual Cloud Storage Service at any time during your subscription period, your annual plan will be prorated over 12 months. Accordingly, you will be responsible for the monthly subscription fee (i.e., fee for the monthly subscription plan) for each month of your annual subscription period prior to your cancellation. If you cancel after a new month of your annual plan has already started, you will be charged for the entire month’s subscription fee. You will be eligible for a refund or credit of the remainder of your annual subscription fee (minus any credits applied or partial refunds issued).
8.2.2 Monthly Plan: You can cancel your monthly Cloud Storage Service at any time during your subscription period. However, monthly plans are not eligible for prorated refunds.

9. Disclaimer

9.1 App does not guarantee that the network services will definitely meet the requirements of the user, nor provide any guarantee for the continuity, timeliness, security and accuracy of the network service.
9.2 App does not guarantee the accuracy and completeness of external links set up for the convenience of users. In addition, App assumes no responsibility or liability for the content of any external pages that are not controlled directly by App. When using related external links, users should identify the content they present, the security of webpage, etc.
9.3 App does not assume any responsibility for losses caused by telecommunication systems or internet network failure, computer failure or virus, information damage or loss, computer system problems, or any other force majeure, but will try its best to reduce their impact on the user.

10. Law and dispute resolution

10.1 This Agreement shall be governed by the laws of the People’s Republic of China.
10.2 Any dispute arising from or in connection with this Agreement shall be settled through friendly negotiation; if the negotiation fails, either party may submit the dispute to the people’s court of jurisdiction where App is located to resolve the dispute.

11. Other clauses

11.1 If any provision of this Agreement is wholly or partially invalid or unenforceable for any reason, or violates any applicable law, this provision is deemed to be deleted, but the remaining provisions of this Agreement shall remain effective and binding.
11.2 App has the right to modify this Agreement at any time in accordance with changes in relevant laws and regulations, as well as adjustments to the company’s operating conditions and business strategies, without separately notifying the user. Users can view the terms of the latest service agreement at any time through the App website. In the event of a dispute, the latest agreement text shall prevail. If the user does not agree to the changes made by App to the relevant provisions of this Agreement, the user has the right to stop using the network service. If the user continues to use the web service, the user is deemed to have accepted the modifications made by App to the relevant terms of this Agreement.
11.3 App has the right to interpret and modify this Agreement to the fullest extent permitted by law.
11.4 This Agreement shall take effective when you register, log in or otherwise use your App Account.
